They could be dismissed as a nuisance, a loose network of individuals living in the United States who call themselves “sovereign citizens” and believe that federal, state, and local governments operate illegally. Some of their actions, although quirky, are not crimes. The offenses they do commit seem minor: They do not pay their taxes and regularly create false license plates, driver’s licenses, and even currency. However, a closer look at sovereign citizens’ more severe crimes, from financial scams to impersonating or threatening law enforcement officials, gives reason for concern. If someone challenges (e.g., a standard traffic stop for false license plates) their ideology, the behavior of these sovereign-citizen extremists quickly can escalate to violence. Since 2000, lone-offender sovereign-citizen extremists have killed six law enforcement officers. In 2010, two Arkansas police officers stopped sovereign-citizen extremists Jerry Kane and his 16-year-old son Joseph during a routine traffic stop on Interstate 40. Joseph Kane jumped out of the vehicle and opened fire with an AK-47 assault rifle, killing both officers. The sovereign-citizen threat likely will grow as the nationwide movement is fueled by the Internet, the economic downturn, and seminars held across the country that spread their ideology and show people how they can tap into funds and eliminate debt through fraudulent methods. As sovereign citizens’ numbers grow, so do the chances of contact with law enforcement and, thus, the risks that incidents will end in violence. Law enforcement and judicial officials must understand the sovereign-citizen movement, be able to identify indicators, and know how to protect themselves from the group’s threatening tactics. Ideology and Motivation The FBI considers sovereign-citizen extremists as comprising a domestic terrorist movement… The FBI considers sovereign-citizen extremists as comprising a domestic terrorist movement, which, scattered across the United States, has existed for decades, with well-known members, such as Terry Nichols, who helped plan the Oklahoma City, Oklahoma, bombing. Sovereign citizens do not represent an anarchist group, nor are they a militia, although they sometimes use or buy illegal weapons. Rather, they operate as individuals without established leadership and only come together in loosely affiliated groups to train, help each other with paperwork, or socialize and talk about their ideology. They may refer to themselves as “constitutionalists” or “freemen,” which is not necessarily a connection to a specific group, but, rather, an indication that they are free from government control. They follow their own set of laws. While the philosophies and Conspiracy theories can vary from person to person, their core beliefs are the same: The government operates outside of its jurisdiction. Because of this belief, they do not recognize federal, state, or local laws, policies, or regulations.1 One prevalent sovereign-citizen theory is the Redemption Theory, which claims the U.S. government went bankrupt when it abandoned the gold standard basis for currency in 1933 and began using citizens as collateral in trade agreements with foreign governments.2 These beliefs can provide a gateway to illegal activity because such individuals believe the U.S. government does not act in the best interests of the American people. By announcing themselves as sovereign citizens, they are emancipated from the responsibilities of being a U.S. citizen, including paying taxes, possessing a state driver’s license, or obeying the law. The Redemption Theory belief leads to their most prevalent method to defraud banks, credit institutions, and the U.S. government: the Redemption Scheme. Sovereign citizens believe that when the U.S. government removed itself from the gold standard, it rendered U.S. currency as a valueless credit note, exchanging one credit document (such as a dollar bill) for another. They assert that the U.S. government now uses citizens as collateral, issuing social security numbers and birth certificates to register people in trade agreements with other countries. Each citizen has a monetary net worth, which they believe is kept in a U.S. Treasury Direct account, valued from $630,000 to more than $3 million. These accounts, they claim, are in a third-party’s name, a “strawman,” that they can access, which they commonly refer to as “freeing money from the strawman.” In essence, it is extorting money from the U.S. Treasury Department. Sovereign citizens file legitimate IRS and Uniform Commercial Code forms for illegitimate purposes, believing that doing so correctly will compel the U.S. Treasury to fulfill its debts, such as credit card debts, taxes, and mortgages.3 At a minimum, these activities create a voluminous influx of documents that clog the courts and other government agencies. But, the idea behind the Redemption Theory also leads sovereign citizens to find criminal sources of income as they travel the country, teach fraudulent tactics to others for a fee, and participate in white collar crimes. The latter offenses include mail, bank, mortgage, and wire fraud; money laundering; tax violations; and illegal firearms sales and purchases. At seminars, sovereign citizens charge participants a fee in exchange for information on Redemption Theory schemes and other methods to avoid paying taxes, sometimes even selling materials, such as CDs or DVDs. They also sell fraudulent documents—including drivers’ licenses, passports, diplomat identification, vehicle registrations, concealed firearms permits, law enforcement credentials, and insurance forms—to other sovereign citizens and illegal immigrants and charge fees for “consultant services” to prepare sovereign-citizen paperwork. Several recent incidents highlight their activities. ■In Sacramento, California, two sovereign-citizen extremists were convicted of running a fraudulent insurance scheme, operating a company completely outside of state insurance regulatory authorities. The men sold “lifetime memberships” to customers and promised to pay any accident claims against members. The company collected millions of dollars, but paid only small auto insurance claims and ignored large ones.4 ■In Kansas City, Missouri, three sovereign-citizen extremists were convicted in a phony diplomatic credential scandal. They charged customers between $450 and $2,000 for a diplomatic identification card that bestowed “sovereign status,” supposedly to enjoy diplomatic immunity from paying taxes and from stops and arrests by law enforcement.5 ■In Las Vegas, Nevada, four men affiliated with the sovereign-citizen-extremist movement were arrested by the Nevada Joint Terrorism Task Force on federal money laundering, tax evasion, and weapons charges. The undercover investigation revealed that two of the suspects allegedly laundered more than a million dollars and collected fees for their services.6 One example of a white collar crime that escalated into a standoff includes a New Hampshire husband and wife convicted of federal income tax evasion, failure to honor federal payroll taxes, and other conspiracy fraud charges. Elaine A. and Edward L. Brown, both sovereign-citizen extremists in their 60s, never appeared at their 2007 trial or at sentencing. In protest, the Browns barricaded themselves in their home during the summer and fall of 2007, receiving supporters, issuing militant and threatening statements, and stockpiling weapons and explosives. They were charged with weapons offenses after their arrest in October 2007 when law enforcement discovered pipe bombs, improvised explosive devices made of gun powder cans with nails and screws taped to the outside, and a large cache of handguns and rifles that included .50-caliber rifles.7 However, even when sovereign citizens go to prison for crimes, they continue criminal activity behind bars. Inmates provide a new population for them to sway to adopt the sovereign-citizen ideology; they then can train these inmates to help them defraud banks, credit institutions, and the U.S. government. They can create fraudulent businesses from inside prison walls and complete fraudulent financial documents to receive lines of credit from legitimate banks. The learning system goes both ways—inmates can teach sovereign citizens new criminal methods that they can use either from inside the prison or when they are released. Indicators It is important to realize sovereign citizens’ tactics to harass and intimidate law enforcement, court, and government officials, as well as financial institution employees. Sovereign citizens often produce documents that contain peculiar or out-of-place language. In some cases, they speak their own language or will write only in certain colors, such as in red crayon. Several indicators can help identify these individuals. ■References to the Bible, The Constitution of the United States, U.S. Supreme Court decisions, or treaties with foreign governments8 ■Personal names spelled in all capital letters or interspersed with colons (e.g., JOHN SMITH or Smith: John) ■Signatures followed by the words “under duress,” “Sovereign Living Soul” (SLS), or a copyright symbol (©) ■Personal seals, stamps, or thumb prints in red ink ■The words “accepted for value”9 They also carry fraudulent drivers’ licenses to indicate their view that law enforcement does not have the authority to stop their vehicle or may write “No Liability Accepted” above their signature on a driver’s license to signify that they do not accept it as a legitimate identification document. Intimidation, Obstruction, and Protection It is important to realize sovereign citizens’ tactics to harass and intimidate law enforcement, court, and government officials, as well as financial institution employees. Methods can range from refusing to cooperate with requests, demanding an oath of office or proof of jurisdiction, filming interactions with law enforcement that they later post on the Internet, and filing frivolous lawsuits or liens against real property. They convene their own special courts that issue fake but realistic-looking indictments, warrants, and other documents. They also can use real government documents, including suspicious activity reports, in an attempt to damage the credit or financial history of specific individuals. While these efforts may seem obviously fraudulent, it is important to address these actions, which can have devastating outcomes for the individuals they target. The sovereign citizens’ efforts also can be a gateway for them to harass, terrorize, and target others in hopes of changing behaviors that they perceive as threatening. The Court Security Improvement Act of 2007 is one protection for officials who the sovereign citizens could target. The provisions under Title 18 created a new criminal offense for false liens against the real or personal property of officers or federal government employees, including judges and prosecutors. It also created as a new crime the disclosure of personal, identifying information to intimidate or incite violence against these individuals.10 Conclusion Although the sovereign-citizen movement does not always rise to violence, its members’… activities…make it a group that should be approached with knowledge and caution. Although the sovereign-citizen movement does not always rise to violence, its members’ illegal activities and past violent—including fatal—incidents against law enforcement make it a group that should be approached with knowledge and caution. It is important that law enforcement be aware of sovereign citizens’ tactics so agencies can warn the public of potential scams, spot illegal activity and understand its potential severity, and be prepared for and protect against violent behavior or backlash through intimidation and harassment. The video is part of Homeland Security’s $10 million dollar “See Something, Say Something” program that encourages Americans to report “suspicious activity,” which in every case throughout history has been a trait of oppressive, dictatorial regimes. In the course of the 10 minute clip, a myriad of different behaviors are characterized as terrorism, including opposing surveillance, using a video camera, talking to police officers, wearing hoodies, driving vans, writing on a piece of paper, and using a Cell Phone recording application. Despite encouraging viewers not to pay attention to a person’s race in determining whether or not they may be a terrorist, almost all of the scenarios in the clip proceed to portray white people as the most likely terrorists. Bizarrely, nearly every single one of the “patriotic” Americans who reports on their fellow citizen is either black, Asian or Arab. Imagine if the video had portrayed every terrorist as an Arab and every patriotic snoop as white, there’d be an outcry and rightly so, but this strange reversal must have been deliberate on the part of the DHS, but why? Is this merely political correctness taken to the extreme or is something deeper at work? Perhaps it has something to do with the fact that the DHS’ own internal documents list predominantly white conservative groups as the most likely terrorists, such as Ron Paul supporters, gun owners, gold bullion enthusiasts, and a myriad of other comparatively banal political interests that are largely the domain of white middle class Americans. This has little to do with the color of a person’s skin, and everything to do with the fact that white, middle class Americans are the biggest roadblock when it comes to Big Sis expanding its control over every facet of American society. It’s plain to see that very little of the budget for this video went towards paying for decent actors, but perhaps it’s fitting that the participants were about as believable as Santa and his elves, because the notion that terrorists are hovering around every underground parking lot waiting to blow up federal buildings is demonstrably false. As Ohio University’s John Mueller has documented, the likelihood of actually being a victim of Terrorism is infinitesimally small, and only highlights how such threats are hyperbolically exaggerated for political purposes. Figures collected by Mueller clearly show that Americans are just as likely to be killed by lightning strikes, accident-causing deer, or severe allergic reactions to peanuts. But the facts don’t matter for a federal agency whose primary function is to manufacture fear to keep Americans under control and submissive to the fact that their economic futures and their constitutional rights are being torn to shreds by their own government while it points to a contrived outside threat as a convenient distraction. “At its core, the video is filled with scenes of ordinary citizens spying on each other and alerting the authorities to their compatriots’ suspicious deeds,” writes Simon Black. In my favorite scene, a woman calls the police after snooping over the shoulder of a young man typing away on his smartphone.” Black notes that such videos are solely aimed at reinforcing ignorance, hate and fear for those who still live in darkness and are completely unaware of the real agenda behind Homeland Security’s “see something, say something” charade. But what is that agenda? No matter where you look, from East Germany, to Communist Russia, to Nazi Germany, historically governments who encourage their own citizens to report on each other do so not for any genuine safety concerns or presumed benefits to security, but in order to create an authoritarian police state that coerces the people into policing each other’s behavior and thoughts. As Robert Gellately of Florida State University has highlighted, Germans under Hitler denounced their neighbors and friends not because they genuinely believed them to be a security threat, but because they expected to selfishly benefit from doing so, both financially, socially and psychologically via a pavlovian need to be rewarded by their masters for their obedience. At the height of its influence around one in seven of the East German population was an informant for the Stasi. As in Nazi Germany, the creation of an informant system was wholly centered around identifying political dissidents and those with grievances against the state, and had little or nothing to do with genuine security concerns. This is the kind of society the Department of Homeland Security is, whether deliberately or inadvertently, recreating in 21st century America. It is about as far removed as you can possibly get from the vision the founders of the nation had in mind when they created the Bill of Rights and the Declaration of Independence. Corporate media tells us “sovereign citizens” do not respect “our government.” The FBI’s Counterterrorism Analysis Section produced a report in February stating that activists opposed to government authority and taxation pose a violent threat to law enforcement. The report specifically denotes constitutionalists as terrorists. “As sovereign citizens’ numbers grow, so do the chances of contact with law enforcement and, thus, the risks that incidents will end in violence. Law enforcement and judicial officials must understand the sovereign-citizen movement, be able to identify indicators, and know how to protect themselves from the group’s threatening tactics,” the report states. The FBI linked the suspects arrested after the murder of two police officers in Louisiana last week to violent anarchists on the FBI’s domestic Terrorism watch lists, according to the Associated Press. It is said the FBI was “monitoring” the group. As past experience demonstrates, when the FBI “monitors” a group it often creates extremism and provocateurs violence. It is a distinct possibility the agency placed an informant in the midst of the group before members allegedly engaged in the rampage last week. Infowars.com reported last year that virtually all terror plots in the United States are organized by the FBI. A report published by Mother Jones and the Investigative Reporting Program at the University of California-Berkley revealed the FBI recruits patsies and encourages them to engage in terror plots. On the other hand, the group of suspects may not be politically motivated or associated with the sovereign citizen movement. Police admit that there is scant evidence linking the suspected criminals to the sovereign citizen movement. Sgt. Len Marie, a state police spokesman in Louisiana, said on Saturday it was too early to verify links to the extremist groups associated with the sovereign citizen movement. The FBI and the corporate media have not explained how theft and drugs are linked to the philosophy of sovereign citizens the government claims are constitutionalists. The suspects in the Louisiana murders seem to be criminals involved in theft and drugs, not defrauding banks and the government, activity the FBI attributes to the sovereign citizen movement. Members of the group were allegedly involved in a burglary at a mobile home park laundry in May and are wanted under warrants issued in Tennessee, Nebraska and Louisiana. Despite the lack of evidence linking the group to any political philosophy, the establishment media continues to produce headlines claiming the murders are part of anti-government activity. The Boston Globe, for instance, claims the suspects are “violent anarchists on the FBI’s domestic terrorism watch lists.” “Police say some of the perpetrators could have been heavily influenced by the sovereign citizens movement, a group deemed to be violent anarchists who believes they are not under the jurisdiction of U.S. law and don’t need to fulfill duties, like pay taxes,” the Daily Mail reported on Sunday. The Southern Poverty Law Center claims members of the group “may have ties to the sovereign citizens movement” after a member Terry Smith “identified himself as a sovereign citizen to Tennessee authorities who served him with a search warrant last November,” according to WBRZ in Louisiana. Smith’s alleged comment has provided a pretext for the government to turn the murder of two policemen by criminals allegedly involved in theft and drugs into a hysterical warning about domestic terrorism. The report reveals that the FBI regularly infiltrates communities where they suspect terrorist-minded individuals to be engaging with others. Regardless of their intentions, agents are sent in to converse within the community, find suspects that could potentially carry out “lone wolf” attacks and then, more or less, encourage them to do so. By providing weaponry, funds and a plan, FBI-directed agents will encourage otherwise-unwilling participants to plot out terrorist attacks, only to bust them before any events fully materialize. Additionally, one former high-level FBI officials speaking to Mother Jones says that, for every informant officially employed by the bureau, up to three unofficial agents are working undercover. Entitled Hot Spots of Terrorism and Other Crimes in the United States, 1970-2008 (PDF), the study was produced by the National Consortium for the Study of Terrorism and Responses to Terrorism at the University of Maryland. The organization was launched with the aid of DHS funding to the tune of $12 million dollars. While largely omitting Islamic terrorism - the report fails completely to mention the 1993 World Trade Center bombing – the study focuses on Americans who hold beliefs shared by the vast majority of conservatives and libertarians and puts them in the context of radical extremism. The report takes its definitions from a 2011 study entitled Profiles of Perpetrators of Terrorism, produced by the National Consortium for the Study of Terrorism and Responses to Terrorism, in which the following characteristics are used to identify terrorists. - Americans who believe their “way of life” is under attack; - Americans who are “fiercely nationalistic (as opposed to universal and international in orientation)”; - People who consider themselves “anti-global” (presumably those who are wary of the loss of American sovereignty); - Americans who are “suspicious of centralized federal authority”; - Americans who are “reverent of individual liberty”; - People who “believe in Conspiracy theories that involve grave threat to national sovereignty and/or personal liberty.” The report also lists people opposed to abortion and “groups that seek to smite the purported enemies of God and other evildoers” as terrorists. As we have exhaustively documented on numerous occasions, federal authorities and particularly the Department of Homeland Security have been involved in producing a deluge of literature which portrays liberty lovers and small government advocates as terrorists. The most flagrant example was the infamous 2009 MIAC report, published by the Missouri Information Analysis Center and first revealed by Infowars, which framed Ron Paul supporters, libertarians, people who display bumper stickers, people who own gold, or even people who fly a U.S. flag, as potential terrorists. The rush to denounce legitimate political beliefs as thought crimes, or even mundane behaviors, by insinuating they are shared by terrorists, has accelerated in recent months. Under the FBI’s Communities Against Terrorism program, the bulk purchase of food is labeled as a potential indication of terrorist activity, as is using cash to pay for a cup of coffee, and showing an interest in web privacy when using the Internet in a public place. As we have documented on numerous occasions, the federal government routinely characterizes mundane behavior as extremist activity or a potential indicator of terrorist intent. As part of its ‘See Something, Say Something’ campaign, the Department of Homeland Security educates the public that generic activities performed by millions of people every day, including using a video camera, talking to police officers, wearing hoodies, driving vans, writing on a piece of paper, and using a Cell Phone recording application,” are all potential signs of terrorist activity. As we have documented, under the Obama administration, the characterization of Americans who distrust big government and adhere to constitutionalist principles as domestic extremists or even terrorists has accelerated. Despite encouraging viewers not to pay attention to a person’s race in determining whether or not they may be a terrorist, almost all of the scenarios in the clip proceed to portray white people as the most likely terrorists. Bizarrely, nearly every single one of the “patriotic” Americans who reports on their fellow citizen is either black, Asian or Arab. Imagine if the video had portrayed every terrorist as an Arab and every patriotic snoop as white, there’d be an outcry and rightly so, yet this strange reversal must have been deliberate on the part of the DHS, but why? Is this merely political correctness taken to the extreme or is something deeper at work? In addition to rhetoric from the likes of Vice-President Biden that Tea Partiers are akin to “terrorists,” other legitimate grass roots activists such as End the Fed protesters have also been labeled as dangerous extremists by the federal government. In March 2009 it came to light that the End the Fed protests, which took place at banks and regional Federal Reserve branches across the country the previous year on November 22, were being monitored closely by the United States Army Reserve Command, who implied that those protesting against the Fed and the bankster bailout were essentially terrorists. On November 22, 2008, Alex Jones led a rally at the Federal Reserve Bank in Dallas Texas. The Dallas protest is specifically mentioned in the official Army document. Ron Paul’s brother was also in attendance. The FBI has also gone out of its way to characterize returning veterans from Iraq and Afghanistan as a major domestic terrorist threat. Additionally, Janet Napolitano said she stood by an April 2009 DHS intelligence assessment that listed returning vets as likely domestic terrorists. Just a month later, the New York Times reported on how Boy Scout Explorers were being trained by the DHS to kill “disgruntled Iraq war veterans” in terrorist drills. In March 2009 we broke the story of the infamous MIAC report, leaked to us by two concerned Missouri police officers. The report listed Ron Paul supporters, libertarians, people who display bumper stickers, people who own gold, or even people who fly a U.S. flag and equates them with radical race hate groups and terrorists. Indeed, the MIAC report is just one in a series of similar threat assessment documents released over the last decade that list average American citizens as dangerous extremists and potential terrorists. This characterization stretches back long before the Obama administration came to power. We have highlighted previous training manuals issued by state and federal government bodies which identify whole swathes of the population as potential terrorists. A Texas Department of Public Safety Criminal Law Enforcement pamphlet gives the public characteristics to identify terrorists that include buying baby formula, beer, wearing Levi jeans, carrying identifying documents like a drivers license and traveling with women or children. A Virginia training manual used to help state employees recognize terrorists lists anti-government and property rights activists as terrorists and includes binoculars, video cameras, paper pads and notebooks in a compendium of terrorist tools. Such training documents are manifesting real-life situations where people are being harassed, assaulted and arrested by law enforcement simply for owning material or discussing topics related to the Constitution and the bill of rights. In May 2008, a student of a large bible college in east Texas was accused by federal agents of committing an “act of terror and espionage” after he gave a talk to a group of Boy Scouts in which he encouraged them to educate themselves about the U.S. constitution. In July 2007, the Kuhns, a North Carolina couple, were terrorized by sheriff’s deputy Brian Scarborough, who broke into their house, assaulted them and then arrested the couple for the crime of flying an upside down U.S. flag. The couple were handcuffed, arrested and bundled into a squad car, to the protests of numerous neighbors who demanded to know why the Kuhns were being incarcerated, but were told to leave by police. As is supported by the United States Flag Code as well as a similar incident in 2001, flying the flag upside down is not a mark of disrespect, and in fact is considered by many to be the highest form of patriotism. Despite this fact, the upside down flag is equated in the MIAC report with terrorist paraphernalia. Alex Jones’ 2001 documentary film 9/11: The Road to Tyranny featured footage from a FEMA symposium given to firefighters and other emergency personnel in Kansas City in which it was stated that the founding fathers, Christians and home-schoolers were terrorists and should be treated with the utmost suspicion and brutality in times of national emergency. The lecturer identifies George Washington, Thomas Jefferson and other founding fathers as “terrorists”. In 2004, Kelly Rushing was charged with making “terroristic threats” after he handed out Alex Jones videos and recordings of a Congressman Ron Paul speech on C-Span to Lyon County, Kentucky officials and Kentucky State Trooper Lewis Dobbs. A jury later ruled in favor of Rushing but he continues to be harassed by authorities and local law enforcement. In August 2008, a Las Vegas couple were stopped by police, detained and searched as cops demanded to know if there was anything illegal inside the vehicle. When the couple asked why they had been stopped, the police officer pointed at “Infowars” and “Ron Paul” bumper stickers on their car. In 2001, housewife Abbey Newman was assaulted and arrested by police at a checkpoint for exercising her 4th amendment rights. Cops looked through literature which included a copy of a pocket constitution and debated whether or not the material was illegal. The last decade has seen a deliberate intensification of the talking point that American citizens who are informed about their constitutional rights should somehow be treated with suspicion as potential extremists or even terrorists. This demonization campaign has accelerated so quickly under the Obama administration that conservative middle class Americans are now being targeted by the federal government as the primary terror threat, a process that also serves to chill the very constitutional rights upheld by such “extremists”. Only by becoming aware of how far this agenda has advanced and mounting a huge public relations backlash against it can politically active Americans prevent themselves from becoming victims of a new type of McCarthyism that threatens to intimidate the liberty movement out of existence.
